Murder in the Saloon

In a run down saloon in the roughest region of Texas, One-eye Pete and his gang sat playing poker. There were five men around the table - a rougher, tougher looking group of people you'd never seen in your life. Just to be allowed in the gang you had to skin your own grandma with a rusty potato peeler.
After several games, the men started a new one, but one of them eyed the dealer narrowly. Just as the cards were being dealt out again he leapt up and yelled "I says your cheatin'!"
  It was an unwise comment. The dealer flung out a gun and shot the offender dead, and naturally the sheriff was then sent for. The sheriff was a giant of a man who never went anywhere without two pistols hanging from his belt. He was so mean and tough that he had skinned both his grandmas in a manner too horrible to relate. However, even though he was a stranger to fear, even for the gang, and the incident had been witnessed by everyone in the bar, he was unable to arrest any of the men who had taken part in the game.
  Why was this?

Wow! That's a really good guess, I didn't even think of that one when I got told this puzzle - but it isn't the right answer.
